These terms govern your use of www.capturethatmedia.com and the free tools and resources Capture That Media offers through it.

01Acceptance

By accessing or using capturethatmedia.com (the "Site") and its tools, you agree to these Terms of Use. If you don't agree, please don't use the Site.

02Scope

These terms cover the Site and our free resources, the instant audit, the Mia chat assistant, call booking, and published content. Paid engagements are governed by a separate written agreement or statement of work; if anything in that agreement conflicts with these terms, the signed agreement controls for that engagement.

03Acceptable use

When you use the Site, you agree not to:

  • ·Use it unlawfully, or to harass, defraud, or harm others.
  • ·Scrape, harvest, overload, or attempt to disrupt the Site, our APIs, or our AI tools, or circumvent rate limits and security controls.
  • ·Attempt to gain unauthorized access to any system, account, or data.
  • ·Submit content you don't have the right to submit, or anything malicious.

04Free tools are provided “as is”

Our free audit, Mia, and other resources are provided for general guidance, "as is" and "as available," without warranties of any kind. AI generated output can be incomplete or inaccurate, verify it before relying on it. Nothing on the Site is a guarantee of any specific search ranking, traffic, lead volume, revenue, or other result. Marketing outcomes depend on many factors outside our control.

05Pricing and estimates

Prices shown on the Site are starting points for typical engagements and may change. They are not an offer or a binding quote. Your scope, deliverables, and fees are confirmed in a written agreement before work begins.

06Intellectual property

The Site, its content, the Capture That Media name, and our logo and brand are owned by CTM or our licensors and are protected by law. Don't copy, reproduce, or reuse them without our written permission. Ownership of deliverables we create for a client is governed by that client's engagement agreement.

07Third-party services and links

The Site relies on and links to third-party services (for example, hosting, email, analytics, and AI providers) and to other websites, including our clients'. We aren't responsible for the content, policies, or practices of third parties.

08Disclaimers and limitation of liability

To the fullest extent permitted by law, the Site and free tools are provided without warranties of any kind, and CTM is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the Site or reliance on its content or AI output. Where liability cannot be excluded, our total liability relating to the Site is limited to USD $100.

09Indemnification

You agree to indemnify and hold CTM harmless from claims and expenses arising out of your misuse of the Site or violation of these terms.

10Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Bexar County, Texas.

11Changes

We may update these terms from time to time. Continued use of the Site after we post changes means you accept the updated terms. The "Last updated" date above reflects the latest version.
